Eligibility: OfficePools “NHL Shootout Contest” (Open Hockey Pool) is open to legal residents of Canada, who are eighteen (18) years of age or older, except that you must be nineteen (19) years of age or older if you live in British Columbia, New Brunswick, Newfoundland and Labrador, Northwest Territories, Nova Scotia, Nunavut, Ontario, PEI, Saskatchewan or Yukon; and legal residents of the United States (excluding all U.S. territories, including but not limited to Guam, U.S. Virgin Islands and Puerto Rico) who are twenty-one (21) years of age or older. Sponsor (as defined below), its subsidiaries and affiliates, and any other companies or agencies associated with this Contest are collectively referred to herein as the “Contest Entities”. Employees of the Contest Entities and their immediate family members (defined as parents, parents-in-law, children, siblings and spouse (including common law), regardless of where they reside) are not eligible to enter the Contest or win Contest prizes. Any other persons with whom such employees are domiciled are also not eligible to enter the Contest or win Contest prizes. VOID WHERE PROHIBITED.

Season: As used herein, “Season” means the Regular Season of the NHL (National Hockey League) that begins on October 7, 2022, and concludes on April 13, 2023

Sponsor: The Contest is sponsored by Officepools.com Services Ltd., 5th floor, 88 E Pender St, Vancouver, BC V6A 3X3, Frameworth Sports Marketing, 1198 Caledonia Road, Toronto, ON M6A 2W5, Canada

Agreement to Official Rules: By participating in this Contest, entrants agree to abide by the terms and conditions thereof as established by the Sponsor. Sponsor reserves the right to qualify all submissions and to reject any submissions that do not meet the requirements for participation as established by Sponsor.

Entry Period: The Contest will accept Entries beginning September 28, 2022, at 3:00 pm Eastern Daylight Time up to October 7, 2021, at 2:00 pm Eastern Daylight Time (the “Entry Period”). Picks received before or after the Entry Period are void. OfficePools computer server, on which the Contest is hosted, is the official time-keeping device for the Contest.

If you don’t already have an account, simply visit OfficePools at https://www.officepools.com/accounts/signup/. Creating an Account is free. By submitting your information, you agree to the Sponsor’s Web Site Use Agreement (https://www.officepools.com/site/terms). If you do not agree to the Web Site Use Agreement, you cannot create an Account or participate in this Contest. After signing up for an Account, you must

authenticate your Account by clicking on the link in the verify email that will be sent to the email address you provided.

Rules:

• ●  One entry per person.

• ●  You must have three forwards, two defencemen, and one goalie on your team at all times.

• ●  The salary cap is $30 million. A team must not go over the salary cap at any time or they’re eliminated.

• ●  Every team has one trade per month. They do not carry over.

• ●  Trades keep the old player's points and only get the new player's points from the trade date forward.

Points:

• ●  Goal: 1 point

• ●  Assist: 1 point

• ●  Hat Trick: 2 points

• ●  Goalie Win: 2 points

• ●  Goalie Shutout: 3 points

   

There is one entry per person. You cannot use the same account or multiple accounts to enter in the Contest. Anyone found to be breaking this rule of multiple entries will be disqualified.

Normal internet access and device usage charges imposed by your online service provider may apply. Sponsor assumes no responsibility for computer system, hardware, software or program malfunctions or other errors, failures, delayed computer transactions or network connections that are human or technical in nature, or for damaged, lost, late, illegible or misdirected entries; technical, hardware, software, electronic or telephone failures of any kind; lost or unavailable network connections; fraudulent, incomplete, garbled or delayed computer transmissions whether caused by Sponsor, users, or by any of the equipment or programming associated with or utilized in this Contest; or by any technical or human error that may occur in the processing of submissions or downloading, that may limit, delay or prevent an entrant’s ability to participate in the Contest. Sponsor is not liable for any loss, injury or damage caused, whether directly or indirectly, in whole or in part, from downloading data or otherwise participating in this Contest.

Sponsor reserves the right to introduce new features that might impact the contest scoring and gameplay. In this event, the Terms & Conditions will be updated to reflect the changes.

Sponsor reserves the right, in its sole discretion, to cancel this Contest for any reason, including if viruses, bugs or other causes beyond Sponsor’s control, unauthorized human intervention, malfunction, computer problems, phone line or network hardware or software malfunction, which, in the sole opinion of Sponsor, corrupt, compromise or materially affect the administration, fairness, security or proper play of the Contest or proper submission of Picks.

In the event of any ties, the following tiebreakers will take place in the indicated order:

1. Entry with the most goals.

2. The highest-ranked entry in the overall standings

3. Draw from among those still qualified after exhausting tiebreakers 1 and

Requirements and Notification of all Prize Winners: The Winner(s) of all prizes will be notified via email on or about five (5) business days after the end of each prizing period. If any of the Winners do not acknowledge acceptance of his or her prize within ten (10) business days after being notified that he or she is a Prize Winner, the prize may be forfeited and awarded to the next eligible entry in terms of prize qualifying. In the event that there is no other eligible winner, the Sponsor reserves the right to not award the prize. Regardless of residency, all winners shall be required to correctly answer, without the assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered during a pre-arranged telephone call or by e-mail. If the Prize Winner does not correctly answer the skill-testing question, the prize will be forfeited. Sponsor may require the Prize Winner to provide a copy of valid government-issued photo identification as evidence of age and identity and to sign and return an affidavit of eligibility and liability and publicity release, wherever lawful, as a precondition to award of the prize. If the Prize Winner fails to provide such identification and sign and return the requested documents to Sponsor in the time indicated by Sponsor, that Prize Winner may be disqualified, the prize may be forfeited and awarded to the next eligible entry in terms of prize qualifying. The prize shall be delivered to the Prize Winner at the mailing address provided by the Prize Winner.

Privacy: By submitting an entry, entrants acknowledge and agree that any personal information that they provided will be maintained in accordance with OfficePools.com Services Ltd’s “Website Use Agreement”, which can be viewed here: https://www.officepools.com/site/terms. By participating in the Contest, you: (i) grant to the Sponsor the right to use your name, mailing address, telephone number, email address, user name, Private Team name, and gameplay information (including but not limited to Picks, scores, and standings) (“Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the winners; (ii) grant to the Sponsor the right to use your Personal Information for publicity and promotional purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledge that the Sponsor may disclose your Personal Information to third-party agents and service providers of the Sponsor in connection with any of the activities listed in (i) and (ii) above. Sponsor will use the entrant’s Personal Information only for identified purposes and protect the entrant’s Personal Information in a manner that is consistent with the Website Use Agreement.

RELEASE: ENTRANTS AGREE TO RELEASE AND HOLD HARMLESS THE CONTEST ENTITIES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THIS CONTEST. ENTRANTS AGREE THAT THE CONTEST ENTITIES AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS ARE NOT LIABLE FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND ARISING FROM PARTICIPATION IN THIS CONTEST AND ACCEPTANCE, POSSESSION AND USE OF ANY

PRIZE. SPONSOR IS NOT RESPONSIBLE FOR ANY TYPOGRAPHICAL OR OTHER ERROR IN THE PRINTING OF THE OFFER OR ADMINISTRATION OF THE CONTEST OR IN THE ANNOUNCEMENT OF THE PRIZE. NO ENTRIES WILL BE RETURNED. ALL ENTRIES BECOME THE PROPERTY OF THE SPONSOR.

DISPUTES EACH ENTRANT AGREES THAT:

TO THE EXTENT PERMISSIBLE BY LAW ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORTING TO ANY FORM OF CLASS ACTION, EXCEPT THAT YOU MAY ASSERT CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY;

1. ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS' FEES; AND

2. UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.

JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF ENTRANT AND SPONSOR IN CONNECTION WITH THE CONTEST, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH THE LAWs OF THE PROVINCE OF BRITISH COLUMBIA, PROVIDED THAT NOTWITHSTANDING THE FOREGOING, IN THE CASE OF CANADIAN RESIDENTS, APPLICABLE LAWS IN CANADA MAY REQUIRE THAT THE LAWS OF THE CANADIAN JURISDICTION IN WHICH YOU RESIDE APPLY INSTEAD, IN WHICH CASE THE LAWS OF THAT JURISDICTION WILL APPLY.
